There are many types of affidavits. When process servers are referring to an affidavit, they are referring to an affidavit of service, which is also known as a proof of service. It is a document signed by the process server (sometimes under the penalty of perjury) to indicate how a service of process played out. Not all states require a notary. The list at the top of this page are the states that require an affidavit or proof of service to be notarized most often. Some other states such as Texas require a notary in certain cases, and not in others.
